<div align="center">两涉嫌侵权“豪爵”商标的助力车、电动车被查封</div>日前，大长江集团会同江门市工商行政管理局及江门市中级人民法院在有关部门的协助下，先后查封了“金豪爵”和“云天豪爵”两个涉嫌侵权“豪爵”商标的助力车和电动车。　　据知情人士透露，位于番禺区南村镇南大路官堂建业工业园3栋的“广州市钜沣电动车有限公司”，自今年1月开始使用“金豪爵”作为产品名称，合计已生产“金豪爵”助力车300多辆。大长江集团会同江门市工商行政管理局在当地工商行政管理部门的协助下，于5月11日前往该厂查封了14台标有“金豪爵”字样的助力车。6月1日，大长江集团与江门市中级人民法院前往天津市北辰区韩家墅工业区5号的“天津市利丰电动车科技有限公司”，在天津市第一中级人民法院的协助下，顺利查封了215辆标有“云天豪爵”字样的电动车及一条生产线。　　大长江集团的“豪爵”商标于1994年注册使用，包括文字、拼音、图形三个部分，受国家法律保护。质量过硬的“豪爵”牌摩托车于2001年、2004年蝉联两届“中国名牌产品”，2003年被评为“广东省著名商标”，现已拥有较高的市场份额和巨大的消费群体，品牌知名度家喻户晓，在摩托车消费者中享有极高的美誉度和满意度。大长江集团认为，广州市钜沣电动车有限公司生产的“金豪爵”，以及天津市利丰电动车科技有限公司生产的“云天豪爵”，两个产品名中均有“豪爵”字样，其产品外观和包装上也有非常显目的“豪爵”标识，厂家这种“搭顺风车”的商标使用行为严重误导了消费者，造成消费者误认误购，混淆视听，淡化了“豪爵”作为高质量摩托车的大品牌形象，损害了大长江集团的“豪爵”商标权和经济利益。

中国名牌产品与中国驰名商标有何区别目前，国家对名牌的权威认定有“中国名牌产品”和“中国驰名商标”两种方式，二者之间既有联系又有区别。一般而言，“中国名牌产品”必须具有市场知名度高的商标，同样，驰名商标的载体———产品必须是质量过硬、具有竞争优势。但是，中国名牌产品和驰名商标在很多方面有明显的区别： 　　1．二者的法律依据和实施部门不同。中国驰名商标的认定是根据《中华人民共和国商标法》以及依据该法律制定的“商标法实施细则”和国家工商行政管理总局第5号令《关于驰名商标认定和保护规定》，企业的驰名商标必须向国务院工商行政管理部门商标局提出申请，经认定后才为驰名商标并享有驰名商标的各项权利。中国名牌产品的评价是根据《中华人民共和国产品质量法》以及国务院制定的《质量振兴纲要》和国家质量监督检验检疫总局第12号令《中国名牌产品管理办法》，国家质检总局授权中国名牌战略推进委员会统一组织实施中国名牌产品的评价工作。 　　2．二者的内涵不同。驰名商标是指在中国为相关公众广为知晓并享有较高声誉的商标。中国名牌产品是指实物质量达到国际同类产品先进水平、在国内同类产品中处于领先地位、市场占有率和知名度居行业前列的产品。 　　3．二者的对象不同。驰名商标的认定对象既包括国内企业的注册商标，也包括外国企业在华注册的商标，而名牌产品的评价仅限于我国企业的产品，不受理使用国（境）外商标的产品的申请。 　　4．二者的认定的后果不同。认定驰名商标是解决商标侵权纠纷中一种法律保护手段，它采用的是“个案认定”与被动保护的原则。已获得驰名商标的产品如果遇到侵权纠纷，可将驰名商标作为受过保护的记录，提交给商标局进行仲裁。按《驰名商标认定和审议办法》的规定，离开侵权纠纷，驰名商标对该企业没有任何意义。而中国名牌产品的评定则主要是为授予企业一种荣誉，属于国家奖励机制的一部分。 　　《人民日报》 (2005年08月22日 第十五版)

一场维权官司打出驰名商标打了一场侵权官司竟然打出个“中国驰名商标”，山西亚宝药业集团有限公司的这一举动，使“亚宝”成为我省第一个通过司法途径得到认定的中国驰名商标。今天上午，在省工商局召开的新闻发布会上，“亚宝”特殊的认定途径受到人们的关注。 “通过司法途径认定驰名商标是国际惯例，但在中国并不多见，在山西尚属首次。”据省工商局商标处有关人员讲，“亚宝”商标的认定，是因为该企业发现大同某药品销售公司擅自使用“亚宝大药房”的名称后，向大同市中级人民法院提起诉讼，除了要求对方停止侵权、赔偿损失外，亚宝公司还提出了认定为驰名商标的请求。法院根据原告提供的种种证据，最终认定“亚宝”商标为驰名商标。 据了解，以前，对驰名商标的认定是由国家工商部门根据申请批量认定。从2003年起，认定方式有所改变，只有在商标注册人认为其商标受到损害并请求保护其合法权益时，才可以向工商部门提出驰名商标的认定申请。 同时，山西沁州黄小米有限公司的“沁州”商标也荣获了中国驰名商标。与“亚宝”走司法途径不同的是，“沁州”商标的认定则是行政途径，这也是目前我省大部分驰名商标的认定方式。至此，我省的“中国驰名商标”达到10件。

连日本的品牌“本田”都成为“中国驰名商标”！？中国第一品牌“豪爵”不是，这不是可笑荒唐的事情吗？？!!!!!喜欢豪爵！支持豪爵！还需要理由吗？为什么凡是买过“豪爵”品牌摩托车的人，都会不由自主的成为“豪爵”的义务宣传员（包括我！）？——只因为它是中国第一品牌！是中国的品牌！质量第一、性价比第一！这样的好品牌，我们不支持，该支持谁？
